I am seeking a licensed U.S. Trademark Attorney for a one-time consultation. I have a specific brand name I wish to trademark, but there is an existing company with a similar name that has been operating for 17 years.
I am not looking to file yet. I need a professional legal opinion to determine if my brand is viable or if the existing company’s seniority poses a high risk of infringement or a "Likelihood of Confusion" refusal.
Specifically, I need help evaluating:
- Common Law Rights: The impact of their 17-year history vs. my intent to file.
- Likelihood of Confusion: Whether our industries/goods are "related" enough to cause a conflict.
- Geographic Scope: If their local presence limits their rights to block my federal filing.
- Strategic Advice: Should I proceed, tweak the name, or abandon it?
Requirements:
