Job Description
The Broker of Record (“BoR”) is the Virginia-licensed real estate broker designated with the Virginia Department of
Professional and Occupational Regulation (DPOR) as the responsible broker for our multifamily management Company. The BoR provides regulatory oversight, compliance supervision, and licensure accountability for the Company’s property management and leasing activities conducted in Virginia. The BoR is not responsible for daily property operations, staffing decisions, or asset-level financial performance, except as required to ensure compliance with Virginia real estate law and DPOR regulations.
Core Responsibilities 1. Regulatory & Licensing Oversight • Serve as the designated Broker of Record for the Company with DPOR • Ensure the Company maintains: • Proper firm licensure • Required disclosures and brokerage relationships • Compliance with Virginia real estate statutes and regulations • Act as the primary point of contact with DPOR for licensing matters 2. Supervision of Licensed Activities • Provide required statutory supervision of: • Leasing activities • Property management activities that require licensure • Advertising related to real estate services • Establish and approve written policies governing: • Leasing procedures • Brokerage relationships • Advertising standards • Recordkeeping requirements • Periodically review compliance of licensed personnel and activities 3.
Trust Account & Financial Compliance • Oversee compliance related to: • Trust account structure and handling • Security deposits and escrowed funds • Review trust account procedures and reconciliations at a supervisory level • Ensure segregation and proper handling of client funds per Virginia law (Day-to-day accounting remains with operations/finance) 4. Policies, Training & Risk Mitigation • Assist in developing and maintaining: • Compliance manuals • Licensing SOPs • Required disclosures and forms • Provide periodic training or guidance to: • Licensed staff • Management personnel on regulatory changes • Advise leadership on compliance risks and mitigation strategies 5.
Audit & Issue Resolution • Participate in internal compliance reviews as needed • Respond to: • DPOR inquiries • Complaints or audits involving licensed activity • Coordinate with Company leadership and legal counsel to resolve compliance issues Explicitly Excluded Responsibilities
The Broker of Record does not: • Manage day-to-day property operations • Supervise non-licensed operational staff • Make hiring, firing, or payroll decisions • Set rents, approve budgets, or control asset strategy • Handle routine tenant disputes • Perform on-site management duties Authority & Independence • Has authority to require corrective action for compliance deficiencies • Has access to necessary records to fulfill supervisory obligations • Maintains independent professional judgment as required by DPOR regulations Qualifications • Active Virginia Real Estate Broker License in good standing Engagement Structure • W-2 employee or independent contractor • Limited-scope engagement focused on compliance and supervision • Compensation structured as: • Annual salary or • Monthly retainer Pay: Up to $3,500.00 per month
