Project: Strategic IP Consultation for Novel Technical Apparel Startup We are a new direct-to-consumer performance apparel startup seeking an experienced Intellectual Property Attorney to provide urgent strategic guidance on the protection and legality of our core product concept. The project is focused on the foundational legal structure necessary before we begin manufacturing and sourcing. The Core IP Challenge We're launching a premium performance garment into the golf market, but we're not just making another polo.
We are developing a proprietary material/finish engineered to deliver a totally unique performance outcome that solves a common, annoying consumer frustration in this category. This idea is rooted in specialized textile science and finishing techniques. We need an expert who knows this patent landscape well. Deliverables & Immediate Priorities: 1. Freedom to Operate Assessment (Highest Priority): Preliminary search and guidance on potential patent infringement risks related to existing performance textile patents, fiber compositions, or specialty chemical finishes.
Goal: Confirm the concept is viable before we invest in R&D. 2. Patent Strategy: Advising on the potential for Utility Patent protection for our specialized textile process, and guidance on preparing a PPA to protect the idea before sharing specs with manufacturers. 3. Legal Framework Creation: Drafting or reviewing NDAs and IP Assignment clauses for use with freelance designers and overseas mills. 4. Trademark Strategy: Consultation on brand naming conventions and the necessary steps for trademark clearance and registration for the final brand name (currently TBD).
